Understanding the MCSW complaints process
Manitoba's Social Work Profession Act created MCSW as a stand-alone regulator separate from the Manitoba Association of Social Workers (MASW). The Complaints Investigation Committee is the front-end decision-maker.
Response deadlines are set in writing by the Committee, typically about 30 days, with extensions available on request.
The Investigation Committee can dismiss, issue a censure, accept an undertaking, or refer the matter to the Inquiry Committee. Inquiry Committee hearings are public.
Notify your professional liability insurer the day you receive the notice.
What's distinctive about the MCSW complaints process
- MCSW is a stand-alone regulator, separated from MASW (the professional association).
- Investigation Committee includes both social work and public members.
- Inquiry Committee hearings are public; decisions are posted on the MCSW register.
- Practice Standards of MCSW are the operative practice standard cited in most decisions.
What triggers complaints against social workers in Manitoba
Administrative concerns
- •Practising on a lapsed or expired certificate of registration
- •Failing to meet continuing competence / professional development requirements
- •Not reporting a change of name, address, or employer within the required timeframe
- •Failing to disclose a charge, finding, or condition on annual renewal
- •Inadequate or missing case-note documentation discovered on audit
Conduct or practice concerns
- •Dual relationship or boundary concerns (sexual misconduct is a zero-tolerance matter)
- •Confidentiality or privacy breaches under PIPEDA / PHIPA / provincial privacy law
- •Concerns about informed consent or capacity assessments
- •Records management concerns (delayed notes, post-hoc edits, missing files)
- •Communication concerns raised by a client, family member, or other professional
- •Concerns about competence: scope of practice, supervision, modality limits
- •Concerns about fitness to practise (health, substance use, cognition)
How a MCSW complaint typically moves
- 1
Complaint received and acknowledged
The College or Association receives the written complaint, assigns a file number, and sends a written acknowledgement to both parties.
- 2
Notice to the social worker
You are sent a copy of the complaint and supporting materials and invited to provide a written response. The College's professional conduct team is typically your point of contact.
- 3
Investigation
An investigator gathers records (case notes, supervision notes, supervisory logs, agency policies), interviews witnesses, and asks you targeted questions. You have a duty to cooperate, but you are entitled to counsel and to decline to admit fault.
- 4
Written response from the social worker
You submit a written response addressing each allegation, with supporting documentation. This is usually the most important document in the file.
- 5
Review by the Complaints Investigation Committee
The Complaints Investigation Committee reviews the investigation file and your written response. It can take no action, issue advice or a caution, accept an undertaking or consent resolution, or refer the matter forward.
- 6
Possible referral to the Inquiry Committee
Serious matters or unresolved factual disputes may be referred to the Inquiry Committee for a formal hearing on the merits.
Possible outcomes
No further action or dismissal
The committee determines the complaint is unfounded, outside its jurisdiction, or does not warrant further action. The file is closed.
Advice, caution, or reminder
A non-disciplinary measure intended to support reflection on practice. Typically recorded on your College file but usually not posted publicly.
Undertaking or remedial agreement
A voluntary written agreement to take specific steps: additional coursework, a practice review, mentored supervision, or revised documentation practices.
Referral to discipline or formal hearing
A formal hearing-style proceeding before a panel that can issue findings of professional misconduct or incompetence and impose conditions, suspension, or revocation.
Suspension or revocation of registration
Reserved for the most serious findings. These outcomes are typically published on the College's public register.
Practical tips for social workers in Manitoba
- Read the College's letter carefully. Your deadline, the scope of the allegations, and the specific information requested are spelled out there.
- Notify your professional liability insurer the day you receive the notice; many CASW-affiliated policies include legal representation through the complaint and discipline process.
- Request the complete investigation package before drafting your response.
- Do not contact the complainant directly. Communicate only through the College or through counsel.
- Do not alter case notes after the fact. If you discover an error, follow your agency's late-entry policy and disclose it.
